Government Bids and Contracts

Conducting business with the government is not business as usual. Unique practices, vigilant oversight, political considerations, and ever-evolving regulations and statutes demand highly specific legal skills and experience.

For more than two decades, McGlinchey Stafford attorneys have been guiding public and private companies, organizations and individuals in aligning their business strategies with the regulatory and statutory compliance required in government contracts.

Working at the federal, state and local levels, we advise and represent prime contractors and subcontractors in handling all issues concerning:

  • Criminal and Civil Fraud Claims and Investigations
  • The False Claims Act (especially “qui tam” defense)
  • The Foreign Corrupt Practices Act
  • The Government Cost Accounting Standards (CAS)
  • Intellectual Property
  • Internal Compliance Programs
  • The Service Contract Act
  • Mergers and Acquisitions of Government Contract Assets
  • Stafford Act Emergency Procurements
  • The Federal Acquisition Regulation (FAR) and the Defense FAR Supplement
  • The Federal Tort Claims Act
  • Suspension and Debarment
  • GAO/Court of Federal Claims/Agency Level Bid Protests
  • State & Local Bid Protests
  • Contract Disputes Act Claims
  • Federal Construction Projects

Practice Scope

More recently, our attorneys have helped clients handle the many tough business and legal issues raised by natural and not-so-natural disasters on the Gulf Coast.

We are familiar with the “strings attached” to the billions of dollars in public money flowing into the region and offer our services to facilitate good, compliant business practices. We have worked on numerous successful bid protests and contract claims and guided companies through Stafford Act procedures.

One of our lawyers was recently appointed liaison counsel for over 50 banks sued in a recent class action in the Eastern District of Louisiana involving federal disaster relief programs, and is trial counsel for two plaintiff-insurance companies in a significant case against the U.S. Army Corps of Engineers involving the Federal Tort Claims Act.

We are known for precise, persuasive and informed communications with governing authorities and clients. Our lawyers are active in the ABA’s Section of Public Contract Law, and stay involved in committee work to help the government contracts bar work to shape law and policy.

We know government contracting problems often arise suddenly, sometimes like hurricanes or oil rig explosions. Our government contracts practice team deploys the right attorneys on the spot and on time to get the job done consistently with the client’s expectations and legal budget. What we can’t do, we tell you we can’t do. What we can do, we do.
