Jay M. O’Brien is a member of the firm’s Baton Rouge office. He practices in the areas of appellate, commercial, business and intellectual property litigation. Jay represents national companies in complex litigation involving contract disputes, unfair trade practices, land use, subdivision development and construction claims. He has litigated various constitutional issues related to standardized testing in public schools and low to moderate income housing developments. In the intellectual property arena, Jay has litigated patent, trademark, and trade dress infringement suits.
He has served as law clerk for Judge Rhesa H. Barksdale of the U.S. Fifth Circuit Court of Appeals. In addition, Jay has been involved in more than 50 appellate matters from 2002 to 2007. He has conducted extensive appellate litigation regarding unfair trade practice claims, shareholder derivative actions, gaming matters, and health insurance claims.
