Causation Standards under Employment Discrimination Statutes: But-For, Motivating Factor, Pretext: What Does It All Mean?
Read Time: 1 minSteve Beiser (NOLA) will present during the 13th Annual ABA Section of Labor and Employment Law Conference in New Orleans on November 7. Although plaintiffs always bear the burden of proving discrimination, the causation standards courts have constructed do not always seem to mean the same thing to every judge in every jurisdiction. Steve and his co-panelists will explore how causation standards do or do not differ at various procedural stages of a case and when attempting to prove a claim of Title VII discrimination, Title VII retaliation, age discrimination under the Age Discrimination in Employment Act, and other common types of discrimination claims.
