Emerging Litigation Podcast: The False Claims Act with Jack Siegal

An article by Jack discussing this topic will appear in the Journal later this year. During the episode, Jack discusses the False Claims Act’s purpose, and why we may see an increase of FCA claims in the wake of the Coronavirus pandemic recovery.
I think we can expect to see it come up in a lot of the pandemic relief programs. It’s always a good thing when the government is looking to help society recover from something like a pandemic. But to the extent that [the government] is providing relief… that is where the False Claims Act could come into play. I’m not talking about being inherently suspect of the government or fearing the government, but just know that… When you take money from the government, you’re giving the government the ability to come back to you and confirm how the funds have been used. And then, if there are mistakes made, even, you run the risk of an FCA-type of inquiry.
