Supreme Court Just Made It Easier to Sue an Employer

Susan Fahey Desmond, an attorney at McGlinchey Stafford PLLC, said that businesses will need to be careful when it comes to company programs that work to increase diversity or target specific groups of people.
“It is clear that the Court is saying that ‘equal’ means just that — ‘equal,'” Desmond said in an email. “We saw this sentiment when the Court struck down higher education’s use of race in the admission process. Programs that seem to prefer one group over another — even for altruistic purposes — are going to be subject to attack.”
