The First Circuit Court of Appeals affirmed the U.S. District Court for Massachusetts’ opinion that an incompetent taxpayer could not suspend the statutory period for filing for a tax refund because a competent adult held the incompetent taxpayer’s durable power of attorney (POA) and could have acted on the taxpayer’s behalf.
