Member Arthur Rotatori (Cleveland) co-chaired and moderated “What’s Old is New Again: The Future of Bank Partnership Programs from Small-Dollar Installment Loans to Mortgages to Everything.” during the ABA Business Law Section Annual Meeting 2018 on Friday September 14 in Austin, Texas. The program reviewed how depository institutions have partnered with non-bank lenders to offer retail loans to consumers and small businesses and discussed the strategic advantages banks and non-bank partners see in such arrangements and how such arrangements have been structured.

Are You Covered? CFPB’s Proposed Rule Would Severely Limit High-Cost, Small Dollar Loans

On June 2, 2016, the Consumer Financial Protection Bureau (CFPB) released its Proposed Rule that would severely restrict the ability of lenders to make payday, vehicle title, and certain high-cost installment loans. The Rule totals 1,334 pages and was released with, among other things, a 152-page Supplemental Report, which includes factual findings, and a Request for Information (discussed more below), signaling the potential expansion of such protections.
