imilar to its long-standing requirement for vehicle service warranty administrators to be registered, Oklahoma recently enacted SB 541 to require the registration of debt waiver program administrators. Unlike service warranties, which may be purchased regardless of whether the vehicle is bought for cash or financed and are largely administered by third-party administrators, debt waiver programs are linked to the financing of the vehicle. This new requirement may result in a creditor or its assignee, rather than a third party, acting as an administrator for debt waiver programs and needing to register with the Oklahoma Department of Insurance.

On September 15, 2022, the U.S. Court of Appeals for the Second Circuit ruled in Cantero v. Bank of Am. that the National Bank Act (NBA) preempts a New York law requiring mortgage lenders to pay interest on mortgage escrow accounts as it relates to national banks. This ruling creates a circuit split on the issue of NBA preemption of state laws requiring payment of interest-on-escrow accounts.

On July 28, 2022, the Board of Governors of the Federal Reserve System published a proposed regulation to implement the Adjustable Interest Rate Act. Due to problems with LIBOR no longer being representative of the underlying borrowing costs of banks that LIBOR was intended to reflect, LIBOR is scheduled to be discontinued on June 30, 2023.
