Construction Claims Dismissed and Liens Removed in Multiple Lawsuits Against the Owner of a $248-million Hotel and Casino Resort
Where we started: In the midst of constructing a $248 million hotel and casino resort in Baton Rouge, our client, a national hospitality company, faced liens and lawsuits brought by the general contractor and multiple subcontractors in state and federal court. At issue were warranty claims, lien claims, breach of contract claims, acceleration claims, and claims for additional payment by subcontractors. At the time we were retained the client was faced with over 40 claims that exceeded $70 million dollars.
Our strategy – plus more: The McGlinchey Construction team defended all suits and bonded off all liens. In addition, we worked with all parties to obtain a global settlement of all construction issues arising from the project.
Upshot: As part of the global settlement, we negotiated a reasonable closeout process to complete the project and pay legitimate claims, which included the removal of all liens and dismissal of all litigation. Today the L’Auberge Casino and Hotel is a premier destination property in Baton Rouge.
