Asher Klein’s practice includes significant trial experience representing a wide range of financial services industry clients, comprising lenders, mortgage servicers, banks, and other industry stakeholders. In handling such matters as contested residential and commercial foreclosures, bankruptcy, eviction, title curative, auto and student loan litigation, Asher’s clients vary in size from large national concerns to local Federally-chartered credit unions. His advice to clients covers litigation as well as financial risk pertaining to mortgage lending and servicing, default loan servicing, banking, commercial lending, and all manner of distressed loan facilities and workout matters.
Asher also handles general commercial litigation for our clients, ranging from breach of contract matters to fraud issues and compliance matters. Asher’s broad civil litigation experience also includes business disputes, real estate transactional work (residential and commercial), professional liability litigation, individual and commercial tax appeals, property violations, and land use matters. He has also defended clients in criminal matters.
As a practitioner, Asher is a problem-solver, first and foremost. He typically seeks to arrive at the best possible outcome for his clients in the most efficient, cost-effective manner possible. Depending on the situation, this may mean being aggressive, or seeking to evaluate and settle a case early on. Typically, however, he seeks to work with opposing counsel to arrive at a reasonable resolution rather than adopt an unnecessarily adversarial posture.
Asher applies a practical, business-minded approach to his representation of clients. By integrating his clients’ business goals into the development of his case strategy, he can arrive at an approach that is grounded in the issue at hand, and ultimately delivers the best result for each individual client, whether that is final judgment, monetary award from the court, or settlement. Asher is a tough, resourceful and effective trial lawyer. Formally trained in public speaking and rhetoric, he is particularly effective at oral argument, and making a strong case on his feet.
The foundation of his approach to handling disputes is research, analysis and a clear, fact-based analysis of the issues. This typically includes determining which elements of a claim are valid and need to be negotiated, which can be effectively dealt with during motion practice, and which are simply posturing tactics.
By accurately evaluating his cases from an early stage, Asher develops a framework for both determining potential exposure, and arriving at an optimal plan of action. Working closely with his clients, Asher follows up his analysis with a strategy, litigation plan and ultimately, resolution under the best possible terms.
Following law school, Asher completed a New Jersey Judicial Clerkship with Honorable Mitchel E. Ostrer in Mercer County Superior Court’s Criminal Division. He is also a court-trained Small Claims Mediator.
