Eric Simonson is an experienced trial attorney who advises businesses on commercial litigation both at the district court and appellate level in state and federal courts throughout Louisiana. He has also represented clients in state and federal courts in Texas, Mississippi, Alabama, Florida, California, Ohio, New York, Arkansas, Oklahoma, and Tennessee. Eric represents companies in both single-plaintiff and class actions and has argued on multiple occasions before the Louisiana Fourth and Fifth Circuit Courts of Appeal as well as the U.S. Fifth Circuit Court of Appeals.
Eric represents companies in the financial, technology, construction, and other industries in a wide range of commercial contract disputes, lease disputes, and related litigation. He advises on construction litigation involving both commercial and residential properties.
Eric represents mortgage lenders and mortgage loan servicers defending claims brought under the Real Estate Settlement Procedures Act (RESPA), Truth in Lending Act (TILA), Home Ownership and Equity Protection Act (HOEPA), Fair Debt Collection Practices Act (FDCPA), Fair Credit Reporting Act (FCRA), Credit Repair Organizations Act (CROA), and other federal and state statutes. He also represents mortgage lenders and servicers in a variety of bankruptcy matters including the defense of Bankruptcy Rule 2004 examinations sought by the United States Trustee. Eric has represented clients in bankruptcy matters in Louisiana, Florida, Georgia, Michigan, Ohio, and Massachusetts.
Eric is the head of the Commercial Litigation practice in the firm’s New Orleans office. His clients include a major consumer internet site and major financial institutions.
