A key part of any lawyer’s job is communicating the status of a case, and allowing the client to make informed decisions. It’s essential to keep in mind that communication is not a one-time snapshot but a continual assessment meant to inform the client how much to invest in defending the case and reasonable resolution ranges based on the litigation’s expected value. It’s always a moving target.
Marshall Cox is an Associate in the firm’s Product Liability practice group. Based in our New Orleans office, Marshall’s practice focuses on defending manufacturers in products liability litigation, with clients primarily in the automotive and industrial equipment industries. This litigation typically involves allegations of personal injuries or wrongful death caused by an alleged manufacturing or design defect of a product. Marshall also represents healthcare providers in medical malpractice litigation, and manufacturers and premises owners in toxic exposure litigation.
His responsibilities encompass all phases of litigation, from discovery through motion practice and ultimate resolution, whether through dismissal, settlement, or trial. The key issues he assesses for the client are the strengths and weaknesses of plaintiff’s defect theory and the client’s defenses, as well as the magnitude of the plaintiff’s claimed damages. Throughout the course of a case, Marshall applies a bottom line-focused assessment, keeping the client’s business goals in mind.
As a practitioner, Marshall’s writing and communication skills are particularly valued by his clients. Litigation is a fast-moving, fluid and often high-stakes undertaking, and effective lawyering means communicating your position clearly and lucidly to the court and the other side. An effective motion can significantly improve the client’s leverage in settlement negotiations, for example.
Marshall’s approach is to focus on developing clear, persuasive arguments that cut out extraneous detail, hone in on the essential facts and law, and present them in the most effective way. Marshall excels in presenting arguments in a manner that is thorough and substantive, yet succinct and engaging.
