Odera Chuke is an Associate in our New York City office. A member of our Consumer Financial Services Litigation practice group, Odera represents clients in a variety of consumer finance-related businesses in litigation relating to their dealings with consumers. Her client base includes financial institutions such as national and state banks, consumer finance companies, and other providers of consumer financial services.
She assists clients with a wide range of situations, including contested foreclosures, real estate issues, and claims of federal and state regulatory violations, including state and federal consumer protection and lending laws. Odera defends claims involving the Fair Credit Reporting Act (FCRA), the Electronic Funds Transfer Act (EFTA), the Fair Debt Collection Practices Act (FDCPA), Regulation E, the Uniform Commercial Code (UCC), the Bank Secrecy Act (BSA), Negotiable Instruments and Payment Systems, and others.
Consumer finance-related litigation, particularly foreclosures, are especially challenging because they are frequently highly emotionally loaded. In a matter pitting a consumer against a bank or financial institution, there is a common preconception that the bank is in the wrong. To counter this, Odera emphasizes extensive research, very careful and thorough preparation, and methodical presentation of the most fact-based case possible.
Odera considers herself a problem-solver and technician, working to assemble facts, law, and strategy into a solid, grounded case that resolves disputes logically and definitively. The answer, she believes, is almost always in the facts of the case.
On a high level, most of her cases involve some form of asset recovery for financial institutions – recovering collateral for breach of a loan agreement or a contract, for instance, or defending a lawsuit from a consumer alleging some kind of error. Day-to-day, this involves handling the full spectrum of litigation activities, from drafting pleadings to motion practice, hearings, negotiations, and lots of research. Odera is experienced in every phase of litigation, and exceptionally well-versed in the statutes and regulations at issue, as well as the procedural nuances in effect.
Regardless of the specific situation, Odera approaches each matter with an unvarying focus on constructing careful, well-researched and comprehensive cases. By advocating for her clients with an emphasis on facts, she is able to both advocate effectively and manage potentially challenging situations efficiently and advantageously.
