Managing a broad multi-state practice, Richard has served financial institutions and companies from a wide array of industries, including banking and financial services, leasing, energy, healthcare, transportation, maritime, construction, food services, and many others. Many of Richard’s clients are large banks and finance institutions, and he has extensive experience in creditors’ rights work, foreclosure, bankruptcy, reorganization, receiverships, corporate wind-downs, and related matters. Other clients of Richard’s run the gamut from infrastructure developers and service companies to maritime service providers, communications companies, aviation companies, healthcare companies, and many others.
Clients appreciate the breadth and width of Richard’s background in business matters and regularly engage his counsel in any manner of issues ranging from contractual disputes to lender liability issues, dealer floorplan financing matters, non-compete litigation, construction contracts, estate and trust disputes, real estate contracts and leases, and other contractual and unfair trade practices claims. They also rely on him to help them navigate mergers and acquisitions, issues concerning shareholder’s rights and disputes, claims against officers and directors, and derivative actions.
Richard partners with companies and financial services clients to look down the road and formulate legal and business strategies that help their businesses avoid problems and benefit from opportunities. His creditor’s rights practice involves the enforcement of loan and lease obligations and foreclosures associated with a broad cross-section of commercial properties (including multi-family developments, malls, hotels, office buildings, and industrial properties), UCC collateral (including accounts, equipment, inventory, general intangibles, and others), royalty agreements, oil and gas rights, vessels, and even seafood.
Regardless of their mission, Richard guides all his clients with the understanding that cash flow represents the lifeblood of any business. As such, he is often called upon to assist with their capital structures and related matters. He helps alleviate clients’ macro-level concerns and on the micro-level, Richard helps clients handle the myriad of legal and operational details that they must address to thrive in the ever-evolving business landscape.
Richard routinely appears in courts across the country and has been admitted pro hac vice in California, Delaware, Florida, Mississippi, Missouri, New York, North Carolina, and Texas to name a few.
