The Florida Supreme Court issued its opinion Thursday, November 3 in the much-anticipated case of Bartram v. U.S. Bank. At issue was the question of whether a previous involuntarily dismissed foreclosure action triggered application of the statute of limitations to prevent a subsequent foreclosure based on payment defaults occurring after the dismissal of the earlier foreclosure action.

As businesses of all varieties witness increasing spikes in litigation and struggle to comply with many aspects of the Telephone Consumer Protection Act ("TCPA" or "Act"), 47 U.S.C. 227, many hoped relief would come from the Federal Communications Commission ("FCC") in response to the dozens of petitions pending before it. These petitions sought clarification of the scope of the statute through key definitions like "automatic telephone dialing systems," "called party," "prior express consent," "making" and "initiating" calls, as well as resolution of significant compliance challenges based on the statute's silence with respect to revocation of consent and the effect of reassigned telephone numbers and requests for specific exemptions.

The latest enforcement action by the Consumer Financial Protection Bureau (“CFPB”) focuses on the military allotment process, fees associated with this method of repayment and one of the agency’s favorite topics – ancillary products. The Justice Department Joins the Fight Against Lance Armstrong

On January 30, 2013, the Louisiana Supreme Court issued its decision in State of Louisiana and the Vermilion Parish School Board v. The Louisiana Land & Exploration Company, et al. Among other things, that decision addressed a mineral lessee’s obligation to remediate contaminated property in legacy oilfield cases in those instances where the lease did not require the surface of property to be restored to its prelease condition. The Supreme Court concluded that, at least in certain circumstances, a landowner would be entitled to collect damages above and beyond the cost of restoring the property to regulatory standards established by the Office of Conservation of the Louisiana Department of Natural Resources.

On July 2, 2012, the California State Senate and Assembly passed a pair of identical anti-foreclosure bills, SB 900 (approved 25-13) and AB 278 (approved 53-25), which promulgate significant portions of the California Homeowner Bill of Rights legislative package promoted by California Attorney General Kamala Harris. The Homeowner Bill of Rights adopts many of the core provisions of the national mortgage settlement reached earlier this year with the nation’s five largest mortgage servicers. SB 900 and AB 278 would extend the servicing restrictions found in the settlement to other mortgage servicers in California, although the legislation will primarily impact entities that conduct more than 175 foreclosure sales per year in the state. The legislation is applicable to first-lien mortgage loans secured by owner-occupied principal residences not exceeding four dwelling units.

In the wake of a continually increasing number of consumer complaints lodged against mortgage loan servicers in Oregon since 2008, the Oregon Department of Justice (“DOJ”) has proposed new rules based heavily on the National Mortgage Settlement Agreement previously entered into with the five largest national mortgage loan servicers. Although the rule parameters are not yet finalized, it is certain that the new rules would cover a large swath of (if not all) mortgage servicers conducting business in Oregon.

Considerable effort was expended during the recently completed session of the Louisiana Legislature to reform the procedures for so-called “legacy lawsuits” arising out of historical oil and gas exploration and production activities. The new legislation was the product of extensive negotiations among representatives of landowners and oil and gas interests over the last several months. What came out of the process were two separate bills – House Bill 618 and Senate Bill 555. Together, the bills are intended to encourage quicker remediation of contaminated sites to regulatory standards, and to encourage earlier resolution of claims.
