Ethics in Contract Negotiations
Read Time: 1 minContract negotiations can create questions as to how to maintain fidelity to, and advocacy for, a client while not breaching obligations of candor and truthfulness. Marshall Grodner (Baton Rouge) will discuss this topic during an American Bar Association Section of Real Property, Trust and Estate Law (RPTE) webinar on April 10. The panel will discuss:
- Ethics when dealing with the other side to the deal – misleading statements as to client intentions, the relative bargaining power of each side to the deal, and actual facts.
- Ethics when dealing with your own client – questions of authority to negotiate, propose and agree to terms, disagreements with your client, safeguarding client confidences, and special issues with complex client organizations and deal structures.
- Ethics of contract negotiations in the digital age- safeguarding and communicating documents and deal terms.
