Madden v. Midland Funding: District Court Edition

Robert Savoie (New Orleans) published an article titled “Madden v. Midland Funding: District Court Edition” in the ABA’s Consumer Financial Services Committee June 2017 newsletter. Robert’s article discussed the Second Circuit’s decision in Madden, which focused on whether a non-depository institution could rely on the interest rate contracted for between the national bank and the borrower pursuant to the bank’s Congressional grant of state interest rate preemption authority.
