Mag Bickford spoke on a panel titled “The NLRB Strikes Again: Will Louisiana or California Strike Back?” for the Alliance of Public Charter School Attorneys in New Orleans, LA on April 6, 2017. The panelists for the session reviewed three recent NLRB decisions; discussed the legal standard applied by the NLRB (a “facts and circumstances” standard which very quickly seems to be transforming into a bright-line rule); explored the possible legal relief available through federal circuit appeal; evaluated political strategies that may quell the NLRB’s current momentum; and brainstormed potential state statutory and regulatory strategies that may provide insurance for advocates and operators should a similar petition be filed for NLRB review in other states.
