Quick and Complex Cross-Border Work Led to Successful Mediation

Where we started: Our client, a European manufacturer, faced personal injury and wrongful death litigation arising from an accident involving a large piece of container handling equipment at the Port of New Orleans. The client called the mobile phone of one of our product liability lawyers asking if we could help locate a forklift expert. Our lawyer, then waiting for a flight home from Los Angeles, canceled the flight to join a conference call on the matter. 

Our strategy – plus more: Our lawyer led the conference call and quickly developed a defense strategy. The work involved preparing scores of witnesses for deposition, as well as addressing unique discovery issues owing to the fact that the Federal Rules of Civil Procedure do not line up with European privacy laws. We retained a London-based E-discovery consultant to develop the necessary search work, including predictive coding. 

Upshot: Ultimately, the timely and robust preparation of our product liability team enabled us to resolve the matter on favorable terms at mediation. The client was extremely pleased.
