What we’re talking about is a misdemeanor false business records case, unless they can tie it to being made to facilitate another felony. The legal analysis I’ve seen… is not exactly what you want if you’re going to prosecute a former President of the United States in a high-profile case.
The DOJ… the worst outcome for them is not to indict the former President. The worst outcome is to indict him and lose. They have to be confident, if they bring a case, that they’re going to win.
