Carefully Calculated and Integrated Legal Maneuvering Resolves Litigation on Many Fronts
Where we started: In a recent multi-layered matter, we represented a company that purchased residential solar arrays after the business venture failed. The company faced lawsuits by and against taxing authorities and civil litigation with other companies. Our lawyers handled the representation in both the administrative and court proceedings.
Our strategy – plus more: While our team focused on those two matters, we also had to pay attention to other disputes, as both companies faced incoming legal artillery from many different angles. We were involved in multiple courts in multiple states as well as in federal court, tax court, and an arbitration. Our client was fighting on a number of fronts simultaneously: with a lender, class action plaintiffs, the other solar company, and state and federal investigations. All the while the specter of more severe ramifications lurked. In what amounted to a complex legal whack-a-mole game, we never knew what trouble would pop up next.
In this complex matter spanning a myriad of arenas, we carefully reasoned through every single step we took, recognizing that every move was significant because of the looming ripple effect that could materialize across the numerous administrative, court, and arbitration matters in which our client was involved. At the same time, on the PR front we had to minimize the public presence of the litigation. The complexity of the situation required our lawyers to integrate each of our legal moves, fully vetting them as we proceeded, and to constantly communicate with each other.
Upshot: Our strategy paid off. We negotiated a favorable settlement with the other solar company and also resolved the liability to the lender. We reached a separate settlement on the class action, cleared the dispute over the tax credits, and were successful in having the state drop its pursuit of some sales tax cases.
