Member Kelly Lipinski (Cleveland) will present “Navigating Legal Issues in Private Loan Origination and Servicing” at the 2025 NCHER Fall Legal Meeting on October 9, 2025, in Denver, Colorado. This presentation will examine the key legal considerations, compliance challenges, and best practices associated with originating and servicing private loans.

The National Council of Higher Education Resources (NCHER) is the nation’s oldest and largest national trade association, representing higher education service agencies that help students and families develop, pay for, and achieve their career, training, and postsecondary educational goals. Members include student loan servicers, guaranty agencies, lenders, secondary markets, private collection agencies, schools, and others that administer federal, state, and private loan and grant programs. Many members, including state agencies and state-designated authorities, also provide higher education awareness, access, outreach, loan default prevention, and financial literacy services.

Nevada Adopts Student Loan Servicer and Private Education Lender Regulations

At the beginning of 2024, Nevada began to require companies that service student loans to obtain a license and comply with numerous operational requirements. The law also regulates companies that make or hold private education loans.[1] After numerous rounds of proposed rulemaking, the Nevada Department of Financial Institutions (DFI) issued implementing regulations on November 15, 2024, that address the process to obtain and maintain a servicer license, seek approval to operate as a federal student loan servicer, create a new limited purpose exemption to the lender license, and establish new substantive regulations that apply to servicers and lenders.
