With extensive experience in all aspects of construction law across the country, our attorneys routinely counsel architects, engineers, contractors, developers, owners, insurers, lenders, and other construction industry players. We represent clients regarding licensing, contractual, financial, business, and insurance matters throughout all stages and aspects of the construction project process.
Our attorneys provide legal guidance and advice regarding pre-project planning, licensing, project finance, and project support. The team regularly litigates payment, delay, design, and defective construction claims in state and federal court and through alternative dispute resolution. We also defend owners, developers, and contractors in construction-adjacent litigation, such as nuisance suits, personal injury suits, and alleged bad faith claims. We routinely represent contractors before state contracting boards.
Project Planning. We counsel clients on project planning and documentation, from standardized AIA forms to project-specific documents, including design-build projects and public-private agreements such as Cooperative Endeavor and Project Partnership agreements. We counsel clients on project-specific insurance requirements such as builder’s risk, owner-controlled insurance programs, and project wrap insurance.
Project Finance. We counsel clients on project lending and financing documents and negotiate or prepare necessary documentation such as construction loan agreements, draw schedules and distribution agreements, payment application documents, and lien waivers. We work with the firm’s Real Estate team to obtain zoning and permitting approvals from local governmental authorities so our clients can avoid unnecessary delays and disruptions in finance and construction.
Project Support. We assist clients with problems as they arise, often preventing costly litigation and moving projects forward. We routinely address contractor licensing issues arising during the course of construction projects, as well as material or labor supplier disputes and termination and replacement contracts.
Dispute Resolution. We routinely handle litigation, arbitration, and mediation involving public and private construction projects, including bid disputes, payment and lien claims, delay and disruption claims, acceleration claims, construction defect claims, design defect claims, differing site conditions claims, and geotechnical, subsurface, and other engineering claims. Our construction team works with the firm’s Labor and Employment team to address labor disputes and safety issues in the context of construction projects.
